Terms of Service

Effective date: July 4, 2026

These Terms of Service ("Terms") form a binding agreement between you and Kalshi MCP ("Kalshi MCP," "we," "us," or "the service") and govern your access to and use of the Kalshi MCP service. Kalshi MCP is a paid, hosted software service. By creating an account, connecting your Kalshi credentials, or otherwise using the service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the service. Please read these Terms carefully — they describe what the service is and is not, place full responsibility for your trading on you, disclaim warranties, and limit our liability.

1. What Kalshi MCP Is — Software Access Only; Not a Broker, FCM, or Adviser

Kalshi MCP is a paid, hosted software service. Its sole function is to provide Model Context Protocol (MCP) software connectivity between your own artificial-intelligence client and your own account at Kalshi, using the Kalshi API credentials that you yourself supply. In plain terms: we are a connector. We help your AI assistant talk to your Kalshi account, and that is all.

Kalshi MCP is not, and does not hold itself out as, a broker-dealer, a futures commission merchant (FCM), an introducing broker, a securities or commodities exchange, a clearing firm, a money transmitter, a financial adviser, an investment adviser, a portfolio manager, or a tax adviser. We are not registered, licensed, or authorized in any of those capacities, and nothing in these Terms or in the service should be read to suggest otherwise.

We do not broker, route, originate, or execute trades on your behalf, and we exercise no investment discretion. We relay only those orders that you have personally approved in your own account; we never act on our own initiative.

Nothing produced by the service or by the AI assistant connected through it — including market data, summaries, analyses, suggested or drafted orders, and computed settlement, profit-and-loss, or tax-style figures — is financial, investment, legal, regulatory, or tax advice, an offer or solicitation to buy or sell anything, or a recommendation or endorsement of any contract, market, or trading strategy. Any such output is general information for your own independent evaluation.

You should obtain your own advice from qualified, independent financial, legal, and tax professionals before making any trading or financial decision. You are responsible for evaluating that information for yourself and for any decision you make based on it.

2. The Service Is Non-Custodial — Funds and Execution Stay on Kalshi

Kalshi MCP is non-custodial. We never hold, receive, control, transmit, or have access to your funds or your positions. We are not a custodian of money or of contracts, and we cannot become one through your use of the service.

All of your funds, balances, orders, order execution, and settlement live entirely within your own Kalshi account, under your own credentials and under Kalshi's control. The service connects to that account only through the API credentials you provide, and through those credentials it can neither withdraw, transfer, nor otherwise move any funds out of your account.

Funding, deposits, withdrawals, account balances, and any dispute concerning money are solely between you and Kalshi. We are not a party to those matters and have no ability to resolve them. Because we never take custody of your funds and never carry out execution or settlement, no claim arising from the custody, movement, execution, or settlement of funds may be brought against us; those functions belong to Kalshi, which is a separate, regulated venue described in Section 6.

3. You Direct and Approve Every Trade — AI Proposes, You Approve

The AI assistant connected through the service only proposes or drafts orders. No order is ever transmitted to Kalshi unless and until you expressly approve that order in your own account. The proposal is a suggestion; the decision is yours alone.

When you approve an order, you authorize and direct that specific action, you confirm its parameters (including market, side, price, and size), and you accept full and sole responsibility for it. The service applies no discretion of its own and never trades on its own initiative or independently of your approval.

You are solely responsible for all activity in or through your account, and for reviewing every proposed order carefully before approving it. Any analysis, suggestion, or drafted order generated by the AI or the software is general information offered for your independent consideration. It is not personalized advice, a solicitation, or a recommendation that you transact.

The service may offer configurable order-size safety limits. These limits are a convenience feature only. They are not a guarantee against loss, they do not ensure that any order is appropriate or safe, and they do not shift any responsibility to us or create any duty of care on our part. You remain fully responsible for every order you approve, whether or not a safety limit applied to it, and configuring, raising, lowering, or removing such a limit is your decision and your responsibility.

4. Assumption of Trading Risk

You expressly acknowledge and agree that your use of the service is entirely at your own risk.

Trading event contracts and prediction-market contracts on Kalshi involves substantial and inherent risk, including the risk of losing the entire amount of capital you commit in your Kalshi account, plus any applicable fees. Prices can move rapidly and unpredictably, contracts can settle against you, and you may lose your entire position.

All trading outcomes — every gain and every loss — are yours alone. You alone bear the financial consequences of the orders you approve and of the markets you choose to participate in.

You agree that we are not responsible for any loss, damage, or adverse outcome arising from your use of the service or from any trade you approve, even where a risk was anticipated, foreseeable, or disclosed, and even where the AI or the software did or did not warn you, flag a concern, or attempt to limit an action. You will not assert, and you waive, any claim that we should have warned you, advised you, stopped you, or intervened in any way.

We make no representation, promise, or guarantee about the performance, profitability, accuracy, or results of any order, any strategy, or any AI-generated suggestion. Past results, illustrative figures, and model outputs are not indicative of future outcomes.

5. Eligibility, Compliance, and Your Kalshi Account

By using the service, you represent and warrant that you are at least 18 years old (or older where a higher age is required where you are located), that you are accessing the service from a jurisdiction where trading on Kalshi is permitted, that you are not a prohibited, restricted, or sanctioned person, and that you have completed any identity verification (KYC) required by Kalshi.

You further represent that you maintain your own valid Kalshi account in good standing, that you are the sole authorized holder of that account, and that you will not share, lend, or provide access to your account or credentials to anyone else.

The service does not perform identity verification or KYC, does not determine your eligibility to trade, and is not available where trading on Kalshi is prohibited. Whether you are eligible to open or use a Kalshi account is solely a matter between you and Kalshi, governed by Kalshi's rules and by applicable law. We do not assess or vouch for your eligibility.

You are responsible for reading, accepting, and complying with Kalshi's Member Agreement, API Developer Agreement, Data Terms, rulebook, and all other Kalshi terms, as well as all applicable laws and regulations. Your use of your own API keys through the service constitutes your own access to Kalshi's API, and you remain bound by Kalshi's terms at all times. Any breach of Kalshi's terms in connection with your use of the service is your responsibility, not ours.

6. Relationship to Kalshi — Independent, Not Affiliated, CFTC-Regulated Venue

Kalshi MCP is an independent, third-party software tool. It is not affiliated with, sponsored by, endorsed by, certified by, or operated by Kalshi or KalshiEX LLC. No partnership, agency, joint venture, or endorsement between Kalshi MCP and Kalshi exists or should be inferred.

"Kalshi" and any related names, logos, and marks belong to their respective owner. We use them only nominatively, to describe the fact that the service interoperates with Kalshi's API. Kalshi does not support, sponsor, or review the service and is not responsible for it.

Kalshi (KalshiEX LLC) is a United States, CFTC-regulated Designated Contract Market (DCM) for event contracts. All order execution, custody of funds, clearing, and settlement occur on Kalshi and are subject to Kalshi's regulation and rules.

Kalshi MCP does not operate a market or exchange and holds no regulated, registered, or licensed status of any kind. The regulation of Kalshi by the U.S. Commodity Futures Trading Commission (CFTC) applies to Kalshi only; it does not extend to, approve, endorse, register, or otherwise cover Kalshi MCP, and nothing about Kalshi's regulated status should be read as conferring any regulated standing on us.

7. Not Responsible for Kalshi or Third-Party Providers

Kalshi is an independent third party that we do not own or control, and the service depends on Kalshi's systems to function. We are not responsible for, and disclaim all liability arising from, Kalshi's availability, uptime, latency, pricing, order acceptance or rejection, market or contract behavior, settlement determinations, account actions, fee schedules, or any other act, error, or omission of Kalshi.

An order you approve may be delayed, modified, partially filled, rejected, or otherwise handled by Kalshi in ways we do not control. We are not liable for any outcome that results from how Kalshi receives, processes, queues, fills, rejects, or settles an order, or from any change Kalshi makes to a market or contract.

Any settlement, profit-and-loss, position, or tax-style figure computed or displayed by the service is provided for convenience only and is not authoritative. Kalshi's own determinations and records control in all cases, and you should rely on Kalshi — not on the service — for definitive figures. Where the service's computed values differ from Kalshi's, Kalshi's values govern.

The service relies on independent, unrelated third-party providers, including Clerk (authentication and identity), Convex (application database and usage metering), Stripe (payment processing), and Vercel (hosting). We are not responsible for and disclaim all liability for the acts, errors, security incidents, outages, latency, or unavailability of these or any other third-party services. Their availability and performance are outside our control.

8. Your Credentials and Account Security

To use the service, you voluntarily provide your own Kalshi API key identifier and corresponding RSA private key. You do so at your election and remain the owner of those credentials.

We handle your credentials as follows. They are encrypted at rest using the Iron sealing format — AES-256-CBC encryption with HMAC-SHA-256 integrity protection and PBKDF2 key derivation. The encrypted credentials are stored in Clerk private metadata, accessible only to our backend. They are decrypted only in-request and used strictly server-side to sign requests to Kalshi on your behalf. They are never exposed or transmitted to your AI client or to any AI model provider, and you may delete your stored credentials at any time using the clear-credentials function in the dashboard, which removes them from active systems and revokes the connection.

We may suspend or revoke a stored credential at any time for security reasons, including suspected compromise, without prior notice and without liability.

By providing your credentials, you authorize us to use them to place the orders you approve and to perform the connectivity functions of the service. You remain responsible for all activity conducted under your Kalshi keys, including activity you authorize through the service.

You are responsible for securing your AI client login and your Kalshi MCP login, for keeping your credentials confidential, and for the scope of API permissions you grant on Kalshi. We recommend granting the narrowest permissions necessary.

No security measure is perfect, and no system can be guaranteed to be free of unauthorized access. We do not warrant or guarantee that your credentials or your account cannot be accessed, intercepted, phished, or misused, and we are not liable for unauthorized access that occurs despite reasonable safeguards. You should monitor your Kalshi account and report any suspected compromise to us and to Kalshi promptly.

9. Kalshi Data Use Restrictions

Any Kalshi market data you access through the service is for your own personal, internal use only and is subject to Kalshi's Data Terms, which you must comply with.

You may not redistribute, resell, publish, broadcast, or otherwise provide Kalshi data — including any cached, stored, or archived copy of it — to any third party.

You may not use Kalshi data to develop software, or to train, build, fine-tune, or develop any machine-learning or artificial-intelligence system or model, without Kalshi's prior written consent.

You are solely responsible for any prohibited or non-compliant use of Kalshi data made by you or through your account, and you will bear the consequences of any such use, including any claim by Kalshi.

10. Acceptable Use

You agree not to use the service for any unlawful purpose, and not to resell, sublicense, rent, or reverse-engineer, decompile, or disassemble the service or any part of it, except to the limited extent such restriction is prohibited by applicable law.

You agree not to attempt to circumvent, disable, or defeat any plan limit, usage metering, order-size limit, rate limit, or security control of the service.

You agree not to use the service from any prohibited jurisdiction, or to evade, undermine, or work around Kalshi's eligibility rules, geographic restrictions, or verification requirements.

You agree not to engage in automated abuse, to scrape the service beyond any permitted use, to introduce malicious code, to overload or interfere with the service or its infrastructure, or to access the service other than through the interfaces we provide.

11. Subscriptions, Trials, Billing, and Refunds

The service is offered on paid subscription plans billed monthly through Stripe: Basic at $5 per month, which includes a 7-day free trial; Pro at $19 per month; and Max at $59 per month. Plan features and included allotments are described at the point of sale.

Usage above the allotment included with your plan is metered and billed as overage at the rates disclosed for your plan. By subscribing, you authorize us and Stripe to charge your designated payment method on a recurring monthly basis for your subscription fee and any overage, and to continue doing so until you cancel.

If your plan includes a free trial, the trial converts automatically to a paid subscription at the end of the trial period unless you cancel before it ends, at which point the recurring charge described above begins. You may change or cancel your plan at any time from the billing portal. Upon cancellation, your subscription remains active through the end of the then-current paid billing period, after which paid access ends; we do not provide pro-rated refunds for partial periods except as required by law or as stated in our refund policy.

Except where applicable law requires otherwise, all subscription fees and metered overage charges are non-refundable, and we do not provide refunds, credits, or pro-rated amounts for partial billing periods, unused allotments, downgrades, or cancellations. The 7-day Basic trial lets you evaluate the service before any charge; if you cancel before a renewal you are not charged for the next period and you keep access through the period you have already paid for.

We may change our prices, plan features, or allotments. We will give you advance notice of any price change affecting your subscription by email or in-dashboard notice before it takes effect, and your continued use of the service after the change takes effect constitutes your acceptance of the new pricing. If you do not agree to a price change, you may cancel before it takes effect.

12. Disclaimer of Warranties (AS IS / AS AVAILABLE)

The service is provided strictly on an "AS IS" and "AS AVAILABLE" basis, with all faults and without warranties of any kind, whether express, implied, or statutory.

To the fullest extent permitted by law, we disclaim all implied warranties, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, as well as any warranties of accuracy, reliability, and uninterrupted or error-free operation.

Without limiting the foregoing, we specifically do not warrant that any order will be transmitted, accepted, executed, filled, or settled correctly, completely, or on time. The transmission and execution of orders depend on Kalshi and other factors outside our control.

We make no warranty as to the accuracy, completeness, timeliness, or reliability of any market data, account data, AI output, or computed value displayed by the service, including positions, settlement figures, profit-and-loss figures, and tax-related figures. Such values may be incomplete, delayed, or incorrect.

We do not warrant that the service's connection to Kalshi or to any third-party provider or subprocessor will be continuously available, secure, or free of interruption.

You are responsible for independently verifying any information, figure, or output before relying on it, and for confirming the definitive position with Kalshi.

13. Limitation of Liability and Damages Cap

To the fullest extent permitted by law, in no event will Kalshi MCP, its operator, or its affiliates, officers, employees, licensors, or subprocessors be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages of any kind arising out of or relating to the service or these Terms.

Without limiting that exclusion, and notwithstanding anything to the contrary, we will not be liable for any trading or investment losses, lost or missed profits, lost or missed trading opportunities, adverse market movements, slippage, failed, delayed, modified, partially filled, or rejected orders, or any loss of or reduction in the funds or positions in your Kalshi account, in each case whether or not such losses were foreseeable and whether or not we were advised of their possibility. You acknowledge that responsibility for all such trading outcomes rests with you and with Kalshi, and not with us.

Our total, aggregate liability for all claims arising out of or relating to the service or these Terms, regardless of the form of action, will not exceed the greater of (a) one hundred U.S. dollars ($100) or (b) the total fees you actually paid us for the service during the twelve (12) months immediately preceding the event giving rise to the claim. Given the subscription pricing of the service, this cap reflects the parties' allocation of risk.

These limitations and exclusions apply regardless of the legal theory on which a claim is based — whether contract, tort (including negligence), strict liability, statute, or otherwise — and even if any remedy is found to have failed of its essential purpose, and even if we have been advised of the possibility of the damages in question.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you; in that case our liability is limited to the maximum extent permitted by law.

14. Indemnification by the User

You agree to defend, indemnify, and hold harmless Kalshi MCP and its operator, affiliates, officers, directors, employees, agents, licensors, and subprocessors from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and legal costs) arising out of or relating to: (a) your use of the service; (b) any order or trade you approve and any resulting outcome; (c) your breach of these Terms; (d) your violation of Kalshi's terms, rules, or eligibility requirements, or of any applicable law or regulation; (e) your misuse, mishandling, or compromise of your credentials, or any prohibited use of data; and (f) your infringement or violation of any right of any third party.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense of that matter. This indemnification obligation survives termination of these Terms and your use of the service.

15. Suspension, Termination, and Service Changes

We may suspend or terminate your account and your access to the service at any time, with or without notice, for any breach or suspected breach of these Terms, for suspected misuse, fraud, or security risk, or as required by law, in each case without liability to you.

Upon suspension or termination, your right to use the service ends, and any stored credentials may be revoked and removed from active systems. You may also delete your credentials and close your account yourself at any time, as described in Section 8. Provisions of these Terms that by their nature should survive termination — including the disclaimers, limitations of liability, indemnification, and governing-law provisions — will survive.

We may modify, update, suspend, or discontinue the service or any feature of it at any time. Where a change is material, we will communicate it as required by applicable law or as otherwise reasonable, for example by email or in-dashboard notice.

We are not liable for any service outage, interruption, or degradation, or for any failure, error, outage, or unavailability of Kalshi or of any downstream provider or subprocessor on which the service depends.

16. Changes to These Terms

We may update or revise these Terms from time to time. When we do, we will update the effective date shown below and will provide notice of material changes as required, by email or in-dashboard notice.

Your continued use of the service after a revision takes effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the service and may cancel your subscription.

The effective date and last-updated date of these Terms are displayed with the Terms. The version in effect at the time of your use governs that use.

17. Governing Law, Dispute Resolution, and Contact

These Terms, and any dispute arising out of or relating to them or to the service, are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Subject to the arbitration provision below, you and we submit to the exclusive jurisdiction of the state and federal courts located in Delaware, and waive any objection to venue or to an inconvenient forum there.

Any dispute or claim arising out of or relating to these Terms or to the service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that either party may instead bring an individual claim in small-claims court if it qualifies. You and we waive any right to a jury trial and any right to participate in a class, collective, consolidated, or representative proceeding, except where such a waiver is not permitted by applicable law. You may opt out of this arbitration agreement by emailing support@kalshi-mcp.com within 30 days of first accepting these Terms; opting out will not affect any other provision of these Terms.

If any provision of these Terms is held invalid or unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect. These Terms, together with any policies and order pages referenced in them, constitute the entire agreement between you and us regarding the service and supersede any prior agreements on that subject. Our failure to enforce any provision is not a waiver of our right to enforce it later, and no waiver is effective unless in writing.
